These Terms of Service ("Terms") govern your access to and use of the Bonsai application and related services (the "Service"), provided by Bonsai ("Bonsai," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement of a parent, guardian, or school that agrees to these Terms on your behalf.

2. Your account

You are responsible for the information you provide, for keeping your login credentials secure, and for all activity that occurs under your account. Notify us promptly at support@bonsaiedu.org if you suspect unauthorized use. You must provide accurate information and keep it up to date.

3. Acceptable use

You agree not to:

• Use the Service for any unlawful, harmful, or abusive purpose.
• Upload content you do not have the right to share, or that infringes others' rights.
• Attempt to disrupt, reverse engineer, overload, or gain unauthorized access to the Service.
• Use the Service to generate content that is illegal, harassing, hateful, or harmful.
• Misrepresent your identity or impersonate others.
• Use the AI features in any way prohibited by the Gemma Prohibited Use Policy (see Section 8).

4. Your content

You retain ownership of the content you create or submit (such as messages, notes, drawings, and uploads). You grant us a limited license to process and store that content solely to operate and improve the Service for you. You are responsible for the content you submit and confirm you have the rights to share it.

5. AI-generated content & educational disclaimer

Bonsai is a learning tool. AI-generated responses may be inaccurate, incomplete, or misleading, and should not be relied upon as professional, academic, medical, legal, or financial advice. Always verify important information independently. You are responsible for how you use AI output, including ensuring it complies with your school's or institution's academic-integrity rules.

6. Intellectual property

The Service, including its design, branding, and software, is owned by Bonsai and its licensors and is protected by intellectual-property laws. These Terms do not grant you any right to our trademarks or branding except as needed to use the Service normally.

7. Third-party services

The Service relies on third-party providers (such as Supabase, Google, Scaleway, Open-Meteo, BigDataCloud, and jsDelivr). Your use of those features may also be subject to the providers' own terms. We are not responsible for third-party services.

8. AI models & open-model licenses (Gemma, Qwen)

Bonsai's AI features are powered by open models served through Scaleway Generative APIs. You can choose between them in the app. The default model ("Everyday") is Gemma, Google's family of open models. The optional model ("Deep Focus") is Qwen, developed by Alibaba Cloud and licensed under the Apache License 2.0.

Gemma is provided under and subject to the Gemma Terms of Use found at ai.google.dev/gemma/terms. Those terms are incorporated into these Terms by reference, and a copy is available at that link.

When you use the Gemma-powered model, your use of Bonsai's AI features must comply with the Gemma Prohibited Use Policy (ai.google.dev/gemma/prohibited_use_policy), which restricts certain uses of that model. By using these features, you agree to those terms and use restrictions.

9. Service availability & changes

We may modify, suspend, or discontinue any part of the Service at any time, and we may update these Terms. If we make material changes, we will update the "Last updated" date and may notify you through the Service. Continued use after changes means you accept the updated Terms.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. Provisions that by their nature should survive termination (such as disclaimers and limitations of liability) will survive.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

12. Limitation of liability

To the maximum extent permitted by law, Bonsai and its providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the Service. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Bonsai from claims, damages, and expenses arising out of your misuse of the Service or violation of these Terms or applicable law.

14. Subscriptions, billing & cancellation

Bonsai offers a free plan and a paid subscription ("Bonsai Pro"). The current Pro price is $5.00 USD per month. The price, the usage limits of each plan, and the features each plan includes are shown in the app and may change as described below.

• Free plan. No payment card is required and the free plan does not expire. It carries lower usage limits than Pro and does not include access to our more capable AI model; the current limits and included features are shown in the app. We may change the free plan's limits and features as described under "Price & plan changes" below.
• Automatic renewal. Paid subscriptions automatically renew at the end of each billing period at the then-current price, and your payment method is charged automatically, until you cancel. By subscribing, you authorize these recurring charges.
• Usage limits & metering. Each plan includes usage allowances — including a limit on requests per minute and per day — and the more capable AI model is available only on Pro; the current limits are shown in the app. To apply these limits we meter your usage — how many prompts you send each calendar month, how many requests you make each day, how many requests reach each model, and how many tokens those requests use. We meter counts only, never the content of your prompts, and the same counts are what we use to work out how much carbon removal your usage requires. See section 2(e) of our Privacy Policy. We may change allowances as described under "Price & plan changes" below.
• Carbon removal. We fund removal of a multiple of the carbon your measured usage emits — currently 2× on the free plan and about 10× on Pro. The multiple that applies is the one in force at the time the usage occurs, so changing plan does not change the commitment already made for usage before the change.
• Payment processor. Payments are processed by Stripe. We do not store your full card details. See our Privacy Policy.
• How to cancel. You can cancel at any time from Profile → Membership → Manage billing (the Stripe customer portal). Cancellation stops future charges and takes effect at the end of your current paid period; you keep access until then.
• Refunds. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial billing periods. If you are a consumer in the EU, the UK, or another jurisdiction that grants mandatory cancellation, withdrawal, or refund rights, those rights continue to apply to you.
• Price & plan changes. We may change the subscription price or plan features. We will give reasonable advance notice, and changes take effect on your next billing period. Continuing your subscription after a change takes effect means you accept the new price.
• Taxes. Prices may not include applicable taxes, which may be added where required.
• Failed payments. If a charge fails, we may suspend access to paid features until payment succeeds, and repeated failure may end your subscription. Your account then reverts to the free plan rather than being closed.
• Promotional / complimentary access. We may offer promo codes or complimentary access at our discretion, and we may change or withdraw such offers at any time.

15. Governing law

These Terms are governed by the laws of the State of California, United States of America, without regard to its conflict-of-laws rules. Any disputes will be subject to the courts located there, unless otherwise required by applicable law.
